Supreme Court to Get Reporter's Privilege Plea


     This article, by Josh Gerstein, tells of a reporter who interviewed someone for information about a CIA operation to provide Iran with flawed nuclear designs as part of an effort to set back that country's alleged nuclear weapons program. The CIA wants to indict the person who leaked the information. The reporter however is refusing to testify and would, "rather go to jail than reveal his sources." The Supreme Court is now reviewing details and will make a decision as to whether or not reporters have the right not to reveal their sources.
     This case could be monumental since it pertains to the First and Fifth Amendments. If the Supreme Court says that reporters do not have the right to with-hold their sources then it begs the questions, "What if that ruling violates certain individuals fifth amendment rights." If that is the case will the Supreme Court be able to make that ruling. If not then out countries national defense is at stake. So either way we run into some sort of problem. However the solution is simple. If our goal in this country is to protect the citizens then the Supreme Court should rule in favor of removing reporters' rights to with-hold their sources. However if it is the case that our governments primary goal and function is to protect citizens' civil, and natural rights (as I believe), then the Supreme Court must rule against and provide measures  to protect future reporters from this situation. One simple way to make this happen is to allow reporters to have a version of the attorney-client privilege. This would allow people to have their first amendment protected and allow the reporters from being held accountable. This would guarantee all party's' rights would not be violated.
